Applicability
These Terms of Service apply to the use of this website and to all orders and agreements concluded via this website between Playseat® and consumers.
By using this website or placing an order, you agree to these Terms of Service.
These Terms of Service apply together with our Privacy Policy, Cookie Policy, Shipping Policy and Return Policy, where applicable.
Products and information
Playseat® offers physical products through this website.
We do our best to display product descriptions, images, specifications, compatibility information, prices and availability as accurately as possible.
Minor deviations in color, size, appearance, packaging or product details may occur and do not automatically constitute a defect.
Obvious mistakes, typographical errors or pricing errors do not bind Playseat®. If such an error affects your order, we may cancel the order and refund any payment already received.
Orders and agreement
An agreement is concluded once you have placed an order and received an order confirmation by email.
After receiving your order, Playseat® may review the order details, payment status, product availability and delivery information.
Playseat® reserves the right to refuse or cancel an order for justified reasons, including but not limited to suspected fraud, incorrect pricing, product unavailability, incorrect delivery details, payment issues or misuse of the website.
If an order is cancelled after payment has been made, any amount paid will be refunded promptly.
Prices and payment
All prices shown on the website include VAT where applicable, unless stated otherwise.
Shipping costs are shown separately during checkout before you complete your order.
Playseat® reserves the right to change prices at any time. Price changes do not affect orders that have already been confirmed.
Payment must be completed using one of the payment methods offered during checkout.
An order will only be processed after payment has been successfully received or authorized, unless otherwise agreed.
Delivery
Orders are delivered to the address provided by the customer during checkout.
Please make sure your delivery address is correct and complete before placing your order. Playseat® is not responsible for delays or failed deliveries caused by incorrect or incomplete address details provided by the customer.
Estimated delivery times are shown where available and are intended as an indication only. Delivery times may vary depending on the delivery country, product type, carrier, availability and circumstances outside our control.
We strive to dispatch orders within 48 hours on business days, provided the product is in stock and there are no payment, address or order-related issues.
If no specific delivery period has been agreed, the order will be delivered no later than 30 days after the agreement has been concluded, unless otherwise agreed with the customer.
The risk of loss or damage transfers to the customer once the product has been delivered to the delivery address or received by the customer or a third party designated by the customer.

Right of withdrawal for EU consumers
If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which you, or a third party designated by you, receive the product.
To exercise your right of withdrawal, you must inform Playseat® of your decision before the withdrawal period has expired. The easiest way to do this is by submitting a request through our contact form.
Please include your order number, the product you would like to return and a clear statement that you wish to withdraw from your purchase.
After informing us of your withdrawal, you must return the product without undue delay and no later than 14 days from the day on which you informed us of your decision to withdraw.
If you exercise your statutory right of withdrawal, we will refund the product price and the standard delivery costs paid for the original shipment, where applicable.
We may withhold the refund until we have received the returned product or until you have provided proof that the product has been returned, whichever occurs first.
Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed.
Return shipping costs are the responsibility of the customer, unless the product is defective, damaged, incomplete or incorrectly delivered.

Exclusions from the right of withdrawal
The right of withdrawal may not apply to:
Products made to the consumer’s specifications or clearly personalized
Products that cannot be returned for hygiene reasons if the seal has been broken, where applicable
Products that are damaged due to misuse, improper assembly or normal wear and tear
These exclusions apply only where permitted by applicable law.
Warranty and conformity
Playseat® guarantees that products conform to the agreement, the product description and applicable legal requirements.
If a product is defective or does not conform to the agreement, the customer may be entitled to repair, replacement, price reduction or refund in accordance with applicable consumer law.
This does not affect your statutory consumer rights.
If your product develops a defect or if you believe your product is not in conformity with the agreement, please submit a request through our contact form. Our team will help determine the most appropriate solution.
Use and installation of products
Playseat® products must be used and assembled in accordance with the product instructions, manuals and safety information provided.
The customer is responsible for ensuring that the product is suitable for their intended use and compatible with their equipment, unless Playseat® has explicitly confirmed compatibility.
Playseat® is not responsible for damage caused by misuse, incorrect assembly, unauthorized modifications, normal wear and tear, improper maintenance or use contrary to the provided instructions.
Liability
Playseat® is responsible for providing products that conform to the agreement and applicable consumer law.
To the extent permitted by applicable law, Playseat® is not liable for indirect damages, consequential damages, loss of data, loss of profits or damage resulting from misuse, incorrect installation, unauthorized modifications or use contrary to the product instructions.
To the extent permitted by applicable law, Playseat®’s liability is limited to the amount paid for the product concerned.
Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law, including statutory consumer rights.
Intellectual property
All intellectual property rights related to this website and Playseat® products, including but not limited to texts, images, logos, product names, designs, trademarks, graphics, videos and other content, are owned by Playseat® or its licensors.
You may not copy, reproduce, distribute, modify, publish or use any content from this website without prior written permission from Playseat®, unless permitted by law.

In violation of applicable laws or regulations
To infringe intellectual property rights or other rights of Playseat® or third parties
To distribute malware, harmful code or other harmful software
To collect personal data without authorization
To interfere with the security, availability or proper operation of the website
To place fraudulent, misleading or abusive orders
Playseat® reserves the right to restrict or terminate access to the website in case of misuse.

Any disputes will be submitted to the competent court in The Netherlands, unless mandatory consumer law provides that another court has jurisdiction.
Amendments
Playseat® may amend these Terms of Service from time to time.
The most current version will always be available on this website.
Changes do not affect orders that were already confirmed before the updated Terms of Service became effective, unless required by law.
Severability
If any provision of these Terms of Service is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force and effect.
The invalid, unlawful or unenforceable provision will be replaced by a valid provision that comes as close as possible to the original purpose of the provision.
Entire agreement
These Terms of Service, together with all referenced policies, constitute the agreement between Playseat® and the customer for purchases made through this website.
