2. Applicability

These Terms of Service apply to all use of this website and to all agreements concluded via this website between Playseat® and consumers (B2C).

By placing an order or using this website, you agree to these Terms of Service.

3. Products and Information

  • All products offered are physical products
  • We strive to display product descriptions, images, and specifications as accurately as possible
  • Minor deviations in color, size, or appearance may occur and do not constitute a defect
  • Obvious mistakes or typographical errors do not bind Playseat®

4. Orders and Agreement

  • An agreement is concluded once you receive an order confirmation by email
  • Playseat® reserves the right to refuse or cancel an order for justified reasons, including suspected fraud or incorrect pricing
  • If an order is cancelled, any payment already made will be refunded promptly

5. Prices and Payment

  • All prices include VAT unless stated otherwise
  • Shipping costs are shown separately during checkout
  • Playseat® reserves the right to change prices at any time; price changes do not affect confirmed orders
  • Payments must be completed using the payment methods offered on the website

6. Delivery

  • Orders are delivered to the address provided by the customer
  • Estimated delivery times are indicative and not binding
  • Playseat® is not liable for delays caused by carriers or circumstances beyond its control
  • Risk of loss or damage transfers to the customer upon delivery

7. Right of Withdrawal (EU Consumers)

You have the right to withdraw from the agreement within 14 days without giving any reason.

Withdrawal period

The withdrawal period expires 14 days after the day you, or a third party designated by you, receive the product.

Exercising the right of withdrawal

To exercise the right of withdrawal, you must inform Playseat® by a clear statement (e.g. email) before the withdrawal period has expired.

Effects of withdrawal

  • We will refund all payments received from you, including standard delivery costs
  • Refunds will be made within 14 days after receipt of the returned product
  • The refund will be made using the same payment method as used for the original transaction

Return conditions

  • Return shipping costs are borne by the customer
  • Products must be returned unused, undamaged, and in original packaging where reasonably possible

8. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  • Products made to the consumer’s specifications or clearly personalized
  • Products that are not suitable for return due to hygiene reasons if the seal has been broken (where applicable)

9. Warranty and Conformity

  • Playseat® guarantees that products conform to the agreement and applicable legal requirements
  • If a product is defective, the customer is entitled to repair, replacement, or refund in accordance with Dutch consumer law
  • This warranty does not affect statutory consumer rights

10. Liability

  • Playseat® is only liable for damages resulting from intent or gross negligence
  • Liability is limited to the amount paid for the product concerned
  • Playseat® is not liable for indirect or consequential damages
  • Nothing in these Terms excludes liability that cannot be excluded under applicable law

11. Intellectual Property

All intellectual property rights related to this website, including texts, images, logos, and designs, are owned by Playseat® or its licensors and may not be used without prior written consent.

12. Use of the Website

You may not use this website:

  • In violation of applicable laws or regulations
  • To infringe intellectual property rights
  • To distribute malware or harmful software
  • To collect personal data without authorization

Playseat® reserves the right to restrict or terminate access in case of misuse.

These Terms of Service are governed by and construed in accordance with the laws of The Netherlands, without prejudice to mandatory consumer protection laws of the customer’s country of residence.

Playseat® reserves the right to amend these Terms of Service at any time. The most current version will always be available on this website.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with all referenced policies, constitute the entire agreement between Playseat® and the customer.
